They play a similar role, but how they&#8217;re chosen and the labels differ, which can be a point of confusion for families.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An executor is the person named in a will to carry out its instructions. The deceased chose them in advance to gather the assets, address debts and taxes, and distribute property to the beneficiaries as the will directs. Once the will is probated, the court generally recognizes and authorizes the executor to act. Because the deceased selected this person themselves, there&#8217;s usually less question about who should be in charge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An administrator fills the same general role when there&#8217;s no executor, typically because the person died without a will, or the will didn&#8217;t name an executor, or the named person can&#8217;t serve. Here, the court appoints someone to administer the estate, often a close family member, following an order of preference set by law. The administrator settles the estate under court supervision and, without a will, distributes the property according to intestate succession rather than written instructions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So the core difference is selection: an executor is chosen by the deceased in their will, while an administrator is appointed by the court when there&#8217;s no one named to serve. The duties overlap heavily, gathering assets, handling debts, and transferring property, but the path to the role and the guiding instructions differ. An attorney can advise who can serve and how to get them authorized. For heirs, the relevant point is that whoever fills the role helps move the property toward clear ownership, and an individual heir can usually still sell their own share alongside that process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A couple of quick questions:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>What&#8217;s the basic difference between an executor and an administrator?<\/em> An executor is named in the will by the deceased; an administrator is appointed by the court when there&#8217;s no will or no one named to serve.
