In Texas, land ownership can be split into two separate parts: the surface and the minerals beneath it. This division surprises a lot of heirs, but it’s common here, especially with rural and ranch land, and it can significantly affect what an inherited property is worth and how it’s handled.<\/p>\n\n\n\n

The “surface interest” is ownership of the surface of the land, what you can see and use: the ground for building, farming, grazing, or living. The “mineral interest” is ownership of the resources beneath the surface, such as oil, gas, and other minerals, along with rights connected to extracting them. These two estates can be owned together or separately. When they’re separated, often described as the mineral estate being “severed,” one party can own the surface while another owns the minerals underneath the same piece of land.<\/p>\n\n\n\n

This matters for inherited property because the two interests can pass down differently and have very different values. A family might own both the surface and the minerals, or they might own only one. Mineral interests can also generate income through leases or royalties if there’s production, which makes them potentially valuable in their own right, separate from the land’s surface value.
