Understandably, people ask whether they can simply refuse it. Texas law does allow a person to disclaim an inheritance, but it works differently from how most people imagine, and getting it wrong can cause problems, so it&#8217;s important to understand the basics before doing anything.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A disclaimer is a formal, legal refusal to accept inherited property. When done correctly, you&#8217;re treated as if you never received the interest at all. But there are firm rules. A disclaimer generally must be in writing, must meet specific requirements, and must usually be made within a limited time and before you&#8217;ve accepted any benefit from the property. If you&#8217;ve already taken control of it or accepted its benefits, the option to disclaim may be lost. These technical requirements are exactly why this isn&#8217;t a do-it-yourself step.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There&#8217;s also a consequence people don&#8217;t expect: you don&#8217;t get to choose where a disclaimed interest goes. When you disclaim, your share passes as if you had died before the previous owner, which means it goes to the next person in line under the law, not necessarily to whomever you might prefer. For some families that&#8217;s fine; for others it creates new complications, sending the interest to someone they didn&#8217;t intend. A disclaimer also doesn&#8217;t put any money in your pocket, since you&#8217;re giving the interest up rather than selling it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That contrast is worth weighing. If your goal is simply to be rid of the property and you don&#8217;t care about receiving anything, a properly executed disclaimer might suit you, and an attorney can tell you whether you still qualify to make one. But if you&#8217;d rather get something for the interest you inherited, selling your share is the alternative: you exit the property and any tax lawsuit, and you walk away with cash instead of empty-handed. An attorney can help you compare the two for your situation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A couple of questions we hear a lot:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Is disclaiming the same as selling my share?<\/em> No. Disclaiming gives the interest up for nothing and sends it to the next heir in line under the law. Selling lets you exit the property and get paid for your share. They lead to very different outcomes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>What if I&#8217;ve already been dealing with the property; can I still disclaim?<\/em> Possibly not. Disclaimers generally must be made within a time limit and before you&#8217;ve accepted benefits from the property.
