Add unpaid taxes and a lawsuit, and it&#8217;s easy to feel stuck between an ex-spouse, a court, and a tax bill nobody wants to claim. These situations come up often, and while the specifics always need a professional&#8217;s eye, understanding the common knots helps.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A frequent problem is a gap between what a divorce decree says and what the property records show. A decree might award the home to one spouse, but if the deed was never formally updated to reflect that, the records can still list both names. Texas is also a community-property state, which adds its own layer to how property acquired during a marriage is treated. The result is that, on paper, both former spouses may still appear connected to the property even when they thought the divorce settled everything, and that lingering connection is what can pull both of them into a tax suit later.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When the taxes go unpaid, the county generally looks to whoever appears as an owner in its records. If both names are still attached, both can end up named in the lawsuit, regardless of what the divorce was supposed to have decided between them. Sorting out who is actually responsible, what the decree requires, and what the records need is a mix of family law and property law, which is exactly why this is a situation to bring to an attorney rather than untangle alone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once the legal picture is clear, the practical choices look like other co-owned-property cases. The decree may dictate who must handle the taxes or sell. If you hold an ownership interest you&#8217;re entitled to act on, you may be able to address the taxes or sell your share to step out. But because a divorce decree can control what each party can and must do with the property, confirming your rights with an attorney first is essential before making any move.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A couple of questions we hear a lot:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>The divorce gave the house to my ex. Why am I named in the tax suit?<\/em> Likely because the property records still list you, even if the decree said otherwise. The county goes by its records, so an unupdated deed can keep you connected. An attorney can advise on correcting it and on your responsibility.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Can I sell my interest to get out of it?<\/em> That depends on what the divorce decree says and what the records show.
