So when a property passes down, it&#8217;s common for at least one heir, and often several, to be living somewhere else entirely. Managing a Texas property&#8217;s taxes, paperwork, and possible lawsuit from another state sounds like a logistical nightmare, especially if you can&#8217;t just drive over to deal with it. The good news is that distance is far less of an obstacle than it used to be.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your ownership doesn&#8217;t depend on where you live. As an heir, you hold your undivided share of the Texas property no matter what state you&#8217;re in, and you have the same ability to sell that share as an heir who lives down the road from it. Being out of state doesn&#8217;t weaken your position or your options; it mostly just changes the logistics of getting things signed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And those logistics are very manageable now. Real estate documents can be signed remotely, either through an online notary over video or with a mobile notary who comes to wherever you are. That means you can complete a sale of your interest without flying to Texas, taking time off work, or coordinating a trip around the rest of the family. Communication happens by phone and email, and the funds from your sale are sent to you by a secure method such as a wire transfer or cashier&#8217;s check.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This matters most when there&#8217;s a tax lawsuit involved. An out-of-state heir can get pulled into a Texas tax suit just like a local one, and trying to engage with a faraway court process is daunting. Selling your share lets you resolve your part of it from home. Selling your portion removes your name from the lawsuit and converts a distant, hard-to-manage inheritance into cash, all without you having to set foot in the state.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A couple of questions we hear a lot:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Do I have to travel to Texas to sell my share?<\/em> No. Closings can be handled remotely with an online or mobile notary, so you can complete everything from your home state.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Is it harder to sell because I&#8217;m not a Texas resident?<\/em> Not at all.
