The gap between those two things is where the most important opportunities to act actually live, so it&#8217;s worth seeing how one leads to the other.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A tax suit begins when the taxing entities file their Original Petition and serve the owners, including identified heirs. If no one resolves the case, it moves toward a judgment. The judgment is the turning point. It establishes the amount of taxes, penalties, interest, and costs owed, and it authorizes the property to be sold to satisfy that amount. In other words, the lawsuit isn&#8217;t the sale; it&#8217;s the step that makes a sale legally possible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the judgment, an order of sale can be issued, directing an officer such as the sheriff or a constable to sell the property. There&#8217;s a notice period in which the sale is posted and advertised publicly, and then the property is auctioned, typically on a scheduled sale day at a designated public location. Whatever the property brings is applied to the taxes and costs first, with the order of any remaining funds set by law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reason this sequence matters is that each stage still leaves room to act, right up until the sale happens. Before judgment, the taxes can often be addressed or a share sold. Even after judgment but before the auction, there&#8217;s frequently still time to sell an interest rather than let it go to a forced sale. The earlier you move, the more value and control you keep, because a planned sale of your share is almost always a better outcome than an auction you didn&#8217;t choose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A couple of questions we hear a lot:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Can I still sell my share after a judgment but before the auction?<\/em> Often yes, there&#8217;s commonly still a window in that gap. Because timing matters and varies by case, it&#8217;s worth checking quickly rather than assuming the chance has passed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>If the property sells at auction for more than the taxes, who gets the extra?<\/em> Any surplus is distributed according to the order the law sets, which can include the owners.
