I Keep Getting Served for a Tax Lawsuit

We see this happen frequently that properties go into tax delinquency after a family member passes.

If no probate gets filed, then the property usually falls to intestacy laws in Texas, which can be confusing.

Put simply, the property goes to the next of kin, whoever that may be. A lot of times the next of kin has no idea that they inherited a piece of the property that their elders owned.

Then, when the county discovers that no probate has been filed for the original owner, and the property has gone into tax delinquency, they will move down the family tree to try to recoup the taxes from the remaining owners.

Many family members tell us, “I have nothing to do with that property.” And while that may be true in terms of a relationship with the property, since no probate was filed, there is likely no other place for the property to go to other than the next of kin.

And in cases like this, it usually doesn’t just get passed down to one person, it gets passed down to 3, or 6, or 9, or 20.

Some people don’t even know the family members listed on these lawsuits with them.

They just want to be removed from the situation. But a lot of our clients don’t want to hire a lawyer for a problem they never caused in the first place.

That’s why we make offers to co-owners of properties in tax lawsuits to buy they out of tax lawsuits they don’t want to be in anymore. We file the transaction with the county so that the county officials know not to bring the family member into the lawsuit after they sell their portion of the property to us.

We solve the problem. No cost out of pocket for the seller.

If you’re looking to remove yourself from a lawsuit and get paid for your interest, no cost to you, call or text us at (469) 708-8003 for an offer today.
